According to a document was prepared by the Congressional Research Service (CRS):

 

In December 2007 the Mortgage Forgiveness Debt Relief Act of 2007 (P.L. 110-142) was enacted and provided a temporary exclusion for qualified canceled mortgage debt. This was intended to prevent homeowners who were granted principal reductions, or who entered into short sale agreements,from owing tax on top of existing financial distress.The provision was originally effective for debt discharged before January 1, 2010. The exclusion for canceled mortgage debt was subsequently extended several times, most recently in the Consolidated Appropriations Act, 2021(P.L. 116-260), which extended it through the end of 2025.

 

The Joint Committee on Taxation (JCT) estimated this extension will reduce federal tax revenues by $2.8 billion between 2021 and 2030. The exclusion applies to qualified residential indebtedness, which is defined as debt, limited to $750,000 ($375,000 if married filing separately), incurred in acquiring, constructing, or substantially improving the taxpayer’s principalresidence that is secured by such residence. Prior to P.L. 116-260 the exclusion was limited to $2 million ($1 million if married filing separately).

Deadlines for Federally Backed Mortgage Forbearance and Foreclosures

Forbearance

​

  • For loans backed by HUD/FHA, USDA, VA, Fannie Mae, and Freddie Mac, you can request an initial forbearance through September 30, 2021.

​

Foreclosure

​

  • Lenders could not foreclose on loans backed by HUD/FHA, USDA, VA, Fannie Mae, or Freddie Mac until after July 31, 2021.

​

If you're having trouble making payments on your federally backed mortgage because of the COVID-19 pandemic, contact your loan servicer before September 30, 2021. Your loan servicer must:

​

  • Defer or reduce your payments for 180 days if you contact them to make arrangements

  • Give you another 180 days of mortgage relief at your request

  • Offer options for how you can make up the deferred or reduced payments. They will discuss these options with you at the end of your forbearance period.

Supreme Court ended the Foreclosure Moratorium on August 26th, 2021. 

US properties saw an increase in Foreclosures, up 27% from the previous month, and up 49% from one year ago. 

An estimated 3.5% of all homes — 1.75 million homeowners are in a forbearance plan with their Mortgage Servicer, according to the Mortgage Bankers Association.


If you were behind on your mortgage prior to Covid-19, unfortunately you are not qualified for the coverage of the CARES ACT.

ADVISORY:  Don't pay a Fee for a Modification. Don't fall victim to rescue scams:  Signing your Deed to someone, selling your home to an investor, paying for a loan modification, or sending money in to a PO Box or any place unverified with your Mortgage company. Most Mortgage servicers allow you to pay online, or give specific instructions on where to mail, pay or wire a payment. Call your Mortgage company to verify before sending money to any location.

 Your hardship may include a variety of items that your lender may consider.
